Terms of Service
These Terms of Service govern your use of yhwh-timepieces.com and purchases made from YHWH Timepieces.
“YHWH Timepieces”, “we”, “us” and “our” refer to the business operated by Thilo Koschuk under the trade name YHWH Timepieces.
Your mandatory statutory consumer rights remain unaffected.

2. Our Online Store
Our online store is operated using Shopify.
Products purchased through our website are sold directly by YHWH Timepieces. Shopify is not the seller of products purchased from us.
3. Products
We make reasonable efforts to describe and display our products accurately.
Colors and appearance may vary slightly depending on lighting, screen settings and the device used to view our website.
Product specifications, designs and availability may be updated where reasonably necessary.
4. Orders
By submitting an order, you make an offer to purchase the products contained in your order.
We may refuse or cancel an order where there is a legitimate reason, including suspected fraud, payment failure, obvious pricing errors or product unavailability.
If an order cannot be fulfilled after payment has been received, the applicable amount will be refunded.
5. Prices & Payment
The applicable product price is the price displayed during checkout when the order is placed.
Applicable shipping costs, discounts, taxes and other charges required to be disclosed will be shown before completion of the purchase.
Payment must be made using one of the payment methods offered at checkout.
6. Promotions & Discounts
Promotions, sales and discount codes may be subject to additional conditions.
Unless expressly stated otherwise, multiple promotional offers may not be combined.
Obvious technical or pricing errors may be corrected where permitted by law.
7. Shipping & Delivery
Orders are normally processed within 1–2 business days.
Standard shipping normally takes approximately 4–9 business days after dispatch.
Delivery times are estimates and may be affected by carrier delays, customs processing, public holidays, severe weather or other circumstances outside our reasonable control.
For consumer purchases, the risk of accidental loss or damage remains with YHWH Timepieces until the goods are received by the consumer or another person designated by the consumer, except where applicable law provides otherwise.

8. Pre-Orders
Certain products may be offered as pre-orders.
Pre-order products will be clearly identified where applicable and may have different estimated dispatch dates.
Any estimated dispatch information displayed on the applicable product page applies to that pre-order.
9. Order Changes & Cancellations
Please review your order carefully before completing your purchase.
If you need to change or cancel an order, contact:

Once an order has been processed or dispatched, changes or cancellations may no longer be possible.
Applicable return and statutory withdrawal rights remain unaffected.
10. Returns & Refunds
Eligible products are covered by our voluntary 60-Day Return Policy.
Consumers may also have separate statutory withdrawal rights.

Our voluntary policies do not restrict mandatory statutory consumer rights.
11. Defective Products
Where goods are defective, consumers retain all rights available under applicable consumer law.
Depending on applicable law and the circumstances, these rights may include repair, replacement, price reduction, termination of the contract and/or damages.
Nothing in these Terms limits rights that cannot legally be excluded or restricted.
12. 2-Year Limited Warranty
Eligible YHWH Timepieces purchased directly from yhwh-timepieces.com are additionally covered by our 2-Year Limited Warranty against manufacturing defects.
The warranty does not cover accidental damage, normal wear and tear, improper use or damage resulting from use outside the product specifications.
Full warranty conditions are stated in our Return & Refund Policy.
This commercial warranty does not restrict statutory consumer rights.
13. Product Use & Water Resistance
Products should be used according to their stated specifications and reasonable care instructions.
A water-resistance rating applies under specified conditions and should not be interpreted as an unlimited guarantee against water damage.
Damage resulting from use outside the stated specifications may not be covered by our commercial warranty.
Statutory rights regarding manufacturing defects remain unaffected.
14. Intellectual Property
Unless otherwise stated, YHWH Timepieces branding, logos, original product designs, photography, graphics, written content and other original website materials are owned by or licensed to YHWH Timepieces.
They may not be reproduced, distributed or commercially exploited without authorization except where permitted by law.
Third-party trademarks and materials remain the property of their respective owners.
15. Reviews & User Content
If you voluntarily provide us with a review, photograph, video, testimonial or similar content, you confirm that you have the necessary rights to submit it.
Where you authorize us to publish or use such content, we may use it for operating and promoting YHWH Timepieces in accordance with applicable law and the permission granted by you.
16. Prohibited Use
Our website may not be used for unlawful activities, fraud, malicious software distribution, interference with website security, intellectual-property infringement, impersonation or unlawful collection of information.
17. Third-Party Services
Our website may use third-party services including payment providers, shipping providers, analytics services and social-media platforms.
Independent third-party services may be governed by their own terms and privacy policies.
18. Website Availability & Errors
We aim to keep our website accurate and available but cannot guarantee uninterrupted operation.
Obvious technical, typographical or pricing errors may be corrected where permitted by law.

YHWH Timepieces remains liable without limitation where liability cannot legally be excluded or restricted, including liability for intent or gross negligence, injury to life, body or health and liability under mandatory product-liability law.
Where legally permitted, liability for ordinary negligence involving the breach of an essential contractual obligation may be limited to reasonably foreseeable losses typical for the contract.
Nothing in these Terms restricts mandatory consumer rights.
20. Data Protection
Personal data is processed in accordance with our Privacy Policy and applicable data-protection law.
Our store is operated using Shopify and other service providers as described in the applicable Privacy Policy.
21. Consumer Dispute Resolution
YHWH Timepieces is not willing or obliged to participate in dispute-resolution proceedings before a consumer arbitration board unless participation is required by applicable law.
22. Governing Law
These Terms and contractual relationships with YHWH Timepieces are governed by the laws of the Federal Republic of Germany.
For consumers, this choice of law does not deprive you of mandatory protections provided by the law of your country of habitual residence where applicable.
23. Severability
If any provision of these Terms is invalid or unenforceable, the validity of the remaining provisions remains unaffected to the extent permitted by law.
24. Changes to These Terms
We may update these Terms where reasonably necessary due to changes in law, our services or our business.
The current version will always be published on our website.
